In keeping with other recent efforts, Fodor's CONCEPTS focuses on the metaphysics of conceptual content, bracketing such epistemological questions as, "How can we know the contents of our concepts?" Fodor's metaphysical account of concepts, called "informational atomism," stipulates that the contents of a subject's concepts are fixed by the nomological lockings between the subject and the world. After sketching Fodor's "what else?" argument in support of this view, we offer a number of related criticisms. All point to the same conclusion: (...) Fodor is ultimately not merely bracketing the epistemology of conceptual content; his theory makes answers to the epistemological questions impossible. (shrink)

Pantheism is a metaphysical and religious position. Broadly defined it is the view that (1) "God is everything and everything is God ... the world is either identical with God or in some way a self-expression of his nature" (H.P. Owen). Similarly, it is the view that (2) everything that exists constitutes a 'unity' and this all-inclusive unity is in some sense divine (A. MacIntyre). I begin with an account of what the pantheist's ethical position is formally likely to be (...) (e.g. objectivist etc.). I then discuss the relationship between pantheism and ecology in the context of the search for the metaphysical and ethical foundations for an ecological ethic. Vol. 13 of John Dewey, The Later Works, brings this edition of Dewey's Collected Works to the fateful years 1938-1939. It contains three main texts Experience and Education, Freedom and Culture, and Theory of Valuation, plus essays and miscellany. The editors, Jo Ann Boydston and Barabara Levine, provide twenty-five pages of Appendices, and Steven M. Cahn has written and excellent Introduction. The hardback version includes a scholarly apparatus featured in each of the volumes of the series.

In this new study of Rousseau, Levine presents a Kantian reading of the Social Contract. By attempting to reveal Rousseau’s anticipation of such Kantian themes as moral right and obligation the author’s purpose has been "to produce a Kantian reading of The Social Contract, a reading that emphasizes the many respects in which Rousseau anticipates Kant and motivates his investigations in moral philosophy". This purported similarity has been noted previously by thinkers such as Hegel and Cassirer. The book also develops (...) the theme that the solution to the conflict between moral autonomy and political authority is the main issue in The Social Contract. Because Rousseau apparently "grasped his conflict better than either Hobbes or Locke" he was able to anticipate Marx’s critique of the contractarian tradition. Consequently, Rousseau’s political philosophy underlies the "deep structure" of contemporary mentality, and continues to dominate our own sense of self, society, and being-in-the-world. While the main issues in Kant’s moral philosophy—autonomy/heteronomy, person/thing, rule of reason/heteronomous irrationalism—are present in ovo in Rousseau, the author warns us of crucial differences between the two thinkers, for example, in Kant the notion of our being forced to our own freedom is absent. But both thinkers share the belief that any conception of the state’s function as merely external coercion or coordination is sub-rational. Also, Kant’s conception of moral autonomy located in the de jure kingdom of political ends is anticipated in Rousseau’s attempt to direct society to the norm of the general will as its legitimate political end. In sum, Levine’s book, while drawing from the previous work of Althusser, avoids the usual Marxist concept manipulation, and gives us an interesting addition to Rousseau scholarship.—H.N.T. (shrink)

Adequate treatment of pain is essential to alleviate suffering, yet studies show that patients with terminal or serious illness receive inadequate pain relief. In the case of terminally ill patients, adequate palliation of pain may be likely to reduce requests for physician-assisted suicide. This issue of the journal addresses barriers to effective pain relief and suggests how treatment of pain can be improved. The symposium features the Pain Relief Act, which is designed to provide practitioners who prescribe controlled substances for (...) pain with protection from inappropriate legal sanctions. Type specimens are used to designate species. What is the nature of the relation between a type specimen and the species it designates? If species names are rigid designators, and type specimens ostensively define species, then that relation is, at the very least, a close one. Levine :325–338, 2001) argues that the relationship of type specimen to a named species is one of necessity—and that this presents problems for the individuality thesis. Namely, it seems odd that a contingently selected specimen (...) should belong to a species of necessity. In considering Levine’s argument, LaPorte suggests that recognizing the distinction between de re and de dicto necessity resolves Levine’s worries. I reconsider the motivating question: does a type specimen belong of necessity to the species that it designates? In light of taxonomic cases and practice the answer is clear: definitively not. This is particularly clear in the case of re-designation of types by taxonomic decree. I explain how this helps reveal how taxonomists prioritize competing theoretical commitments, and offer a defense of the individuality thesis as applied to these particular cases. SavageThe growing discontent with reductivist practices signals a new current in contemporary criticism's understanding of music, literature and art. George Levine's unease with critics who are unable or unwilling to account for their continuing preoccupation with literary texts they expose as "imperialist, sexist, homophobic and racist" illumines the contradiction fueling the reduction of aesthetics to ideology.1 Cultural studies that deploy (...) literature as evidence of the aesthetics' socio-historical substance mask literature's capacity to break open new perspectives on reality by assuming that literary works are politically complicit with the aesthetics' strategic "mystification of the status quo" (A&I, p. 3). Criticism's indifference to its philosophical presuppositions exacerbates the paradox of denouncing a body of works that constitute criticism's aesthetic and intellectual heritage. According to Mario Valdés, literary studies' coming of age mandates that criticism take account of a tradition nurtured by a succession of philosophers including Hans-Georg Gadamer and Paul Ricoeur.2 For Valdés, the post-structuralist realization that literary texts are indeterminate and inexhaustible prohibits replacing the work of art with critical commentaries on it; criticism's collective and determining role belongs to a shared community of commentary whose history and thought is a record of the changing interpretations and understandings of literary texts' meanings. By demystifying absolute music (instrumental music devoid of programmatic associations), a self-proclaimed critical musicology revolts against traditional musicology's perceived political and ideological agenda. Critical musicology militates against the aesthetic conceit that absolute music transcends its social construction. Yet, by overlooking the philosophical presuppositions that set music's autonomy against practical affairs, new musicology accedes to the schema it recoils against.The tradition nurtured by Gadamer's philosophical hermeneutics and Ricoeur's hermeneutic phenomenology represents a critical current whose significance has been overshadowed by postmodernist investments in decoding music's social and political content. In this book, 11 leading scholars contribute to the understanding of the scientific and philosophical works of Moses Maimonides (1135-1204), the most luminous Jewish intellectual since Talmudic times. Deeply learned in mathematics, astronomy, astrology (which he strongly rejected), logic, philosophy, psychology, linguistics, and jurisprudence, and himself a practising physician, Maimonides flourished within the high Arabic culture of the 12th century, where he had momentous influence upon subsequent Jewish beliefs and behavior, upon ethical demands, and upon ritual traditions. The essay published here in English was one of the earliest documents of the birth of the form of idealism which Giovanni Gentile called “Actual Idealism.” The most celebrated full-length statement of it was published in 1916 as General Theory of the Spirit as Pure Act. But there is no other essay in which the relation between Gentile’s view and the great German tradition from which it derives is made so plain.

The first translation into English and the first detailed interpretation of Hegel’s System der Sittlichkeit and of Philosophie des Geistes, the two earliest surviving versions of Hegel’s social theory. Hegel’s central concept of the spirit evolved in these two works. An 87-page interpretation by Harris precedes the translations.

It is shown that the jet mechanism derivable from the Lorentz deformation picture leads to a nearly constant average jet transverse momentum. It is pointed out that this is consistent with the high-energy experimental data. It is pointed out further that this result strengthens the physical basis for the minimal time-energy uncertainty combined covariantly with Heisenberg's space-momentum uncertainty relation.

If critical theory is meant to be the “ruthless criticism of all that exists”, on what basis can critical theory ground its evaluative claims without being self-defeating? Is there a normative ground on which critique can stand? For Jürgen Habermas, critical theory has a ground embedded in the normative logic of communicative interactions. On the contrary, for Michel Foucault, critique can stand on no ground: critique is the refusal of any given ground and the opening up of possibilities for “thinking (...) and acting differently.” In this dissertation, I will show that a reconsideration of the Habermas-Foucault debate can be helpful for elucidating the normative foundations and the tasks of critical theory. Given the incommensurability of Habermas’s and Foucault’s positions, this elucidation aims to forge a non-assimilatory synthesis between them. Juxtaposing Habermas’s emphasis on moral universality and the participant’s perspective with Foucault’s focus on objectivating problematization, I will suggest that, taken in isolation, their critical theories are inadequate, and a ‘synthesis’ of their respective positions can be found in a “critical conception of participatory normativity.” This conception of normativity, which is in some sense outlined in the critical theories of Theodor Adorno and Judith Butler, will offer a way of understanding the normative foundations of critical theory. The merit of Plato’s Laws remains largely untapped by those seeking genuinely collaborative models of the doctor–patient tie as alternatives to paternalism and autonomy. A persistent difficulty confronting proposed alternatives has been surpassing the notion of pronounced intellectual and values asymmetry favoring the doctor. Having discussed two prominent proposals, both of which evince marked paternalism, I argue that reflection on Plato yields four criteria that a genuinely collaborative model must meet and suggest how the Laws addresses them. In the process, (...) the Laws’ doctor–patient tie is shown to be far more nuanced than interpreters have previously observed. Although Plato’s account will not solve our own quandaries, it illustrates how one might retain asymmetry of a kind without capitulating to familiar oppositional modalities. Through this account, I hope to show that the Laws merits fuller inclusion in contemporary discussions than it has heretofore received. (shrink)

In a recent case in the UK, six men stored their sperm before undergoing chemotherapy treatment for cancer in case they proved to be infertile after the treatment. The sperm was not properly stored and as a result was inadvertently destroyed. The men sued the NHS Trust that stored the sperm and were in the end successful. This paper questions the basis on which the judgement was made and the rationale behind it, namely that the men ‘had ownership’ of the (...) sperm, and that compensation was thus due on the grounds that the men’s property had been destroyed. We first argue that the claim is erroneous and enhances the tendency towards the commodification of body parts. We then suggest that the men could have been compensated for the harm done to them without granting property rights, and that this would, at least in philosophical and ethical terms, have been more appropriate. To help illustrate this, we draw on a parallel case in French law in which a couple whose embryos had been destroyed were overtly denied ownership rights in them. Finally, we suggest some possible ethical and practical problems if the proprietary view expressed in the UK ruling were to become dominant in law, with particular focus on the storing of genetic information in biobanks. We conclude that, although compensation claims should not necessarily be ruled out, a ‘no property in the body’ approach should be the default position in cases of detached bodily materials, the alternative being significantly ethically problematic.
